These Terms and Conditions ("Terms") govern your use of the Lumi AI mobile application ("App") operated by Atech Engineering Solutions SRL ("we," "us," or "our"). By downloading, installing, or using the App, you agree to be bound by these Terms.

1. Acceptance of Terms

By accessing and using Lumi AI, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, please do not use the App.

2. Description of Service

Lumi AI is a personal AI assistant mobile application that provides:

• AI-powered conversational responses to user messages
• Personal chat history and message management
• Premium subscription features for enhanced functionality
• Profile customization including optional profile pictures
• Synchronization across devices

3. Eligibility

You must be at least 13 years of age to use this App. If you are between 13 and 18 years old, you may only use the App with the consent and supervision of a parent or legal guardian. By using the App, you represent and warrant that you meet these age requirements.

4. User Account and Registration

4.1 Account Creation

To access certain features of the App, you may need to create an account. You are responsible for:

• Providing accurate and complete information during registration
• Maintaining the security and confidentiality of your account credentials
• All activities that occur under your account
• Notifying us immediately of any unauthorized use of your account

4.2 Account Termination

You may delete your account at any time. We reserve the right to suspend or terminate your account if you violate these Terms.

5. Subscription and Payment Terms

5.1 Free and Premium Features

The App offers both free and premium features:

• Free Version: Limited to 5 messages per day with basic AI functionality
• Premium Subscription: Unlimited messages, enhanced AI features, and priority support

5.2 Subscription Terms

• Billing: Premium subscriptions are billed weekly at the current rate
• Auto-Renewal: Subscriptions automatically renew unless canceled
• Cancellation: You may cancel your subscription at any time through your device's app store settings
• Refunds: Refunds are handled according to the policies of your device's app store (Google Play Store or Apple App Store)

5.3 Price Changes

We reserve the right to change subscription prices with 30 days' notice. Price changes will not affect your current billing cycle.

6. Acceptable Use

6.1 Permitted Uses

You may use the App for lawful personal or commercial purposes in accordance with these Terms.

6.2 Prohibited Uses

You agree not to use the App to:

• Generate, distribute, or request illegal, harmful, abusive, or offensive content
• Violate any applicable laws or regulations
• Infringe upon the rights of others, including intellectual property rights
• Distribute spam, malware, or other malicious content
• Attempt to reverse engineer, hack, or compromise the App's security
• Use the App for any commercial purposes without our written consent
• Impersonate others or provide false information
• Harass, threaten, or abuse other users or our staff

7. Content and Intellectual Property

7.1 Your Content

You retain ownership of the content you submit to the App (messages, profile pictures). By using the App, you grant us a limited license to process your content solely for providing the App's services.

7.2 AI-Generated Content

Responses generated by the AI are created by artificial intelligence and should not be considered as professional advice. You use AI-generated content at your own risk.

7.3 Our Intellectual Property

The App, including its design, functionality, and underlying technology, is owned by Atech Engineering Solutions SRL and is protected by copyright, trademark, and other intellectual property laws.

8. Privacy and Data Protection

Your privacy is important to us. Our collection and use of personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the App, you consent to the collection and use of your information as described in our Privacy Policy.

9. Third-Party Services

The App integrates with third-party services including:

• Firebase: For data storage and synchronization
• RevenueCat: For subscription management
• DeepSeek AI: For AI-powered responses
• Google Play Store: For app distribution and payments

Your use of these third-party services is subject to their respective terms of service and privacy policies.

10. Disclaimers and Limitation of Liability

10.1 Service Availability

We strive to provide reliable service but cannot guarantee uninterrupted access. The App may be temporarily unavailable due to maintenance, updates, or technical issues.

10.3 Limitation of Liability

To the maximum extent permitted by law, Atech Engineering Solutions SRL shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the App.

11. Indemnification

You agree to indemnify and hold harmless Atech Engineering Solutions SRL, its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of the App or violation of these Terms.

12. Termination

12.1 Termination by You

You may stop using the App and delete your account at any time.

12.2 Termination by Us

We may suspend or terminate your access to the App if:

• You violate these Terms
• You engage in illegal or harmful activities
• We are required to do so by law
• We discontinue the App (with 30 days' notice)

12.3 Effect of Termination

Upon termination, your right to use the App will cease immediately, and we may delete your account and data in accordance with our Privacy Policy.

13. Updates and Modifications

13.1 App Updates

We may update the App to add new features, fix bugs, or improve performance. Some updates may be required for continued use.

13.2 Terms Updates

We may modify these Terms at any time. Material changes will be communicated through the App or via email. Your continued use after changes constitutes acceptance of the updated Terms.

14. Governing Law and Dispute Resolution

14.1 Governing Law

These Terms are governed by and construed in accordance with the laws of Romania, where Atech Engineering Solutions SRL is incorporated.

14.2 Dispute Resolution

Any disputes arising from these Terms or your use of the App will be resolved through:

• First, direct negotiation between the parties
• If necessary, mediation in Romania
• As a last resort, litigation in Romanian courts

14.3 EU Consumer Rights

If you are a consumer in the European Union, you may have additional rights under EU consumer protection laws, which these Terms do not limit.

15. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue to be valid and enforceable.

16. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Atech Engineering Solutions SRL regarding the use of the App.
