1. Acceptance of Terms

By downloading, installing, or using Lumi Blocks ("the App"), you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree to these Terms, do not use the App.

These Terms constitute a legally binding agreement between you and Atech Engineering Solutions SRL ("we," "our," or "us").

2. Changes to Terms

We reserve the right to modify these Terms at any time. Changes will be effective upon posting to our website. Your continued use of the App after changes are posted constitutes acceptance of the modified Terms.

• Significant changes may be announced in-app
• It is your responsibility to review these Terms periodically

3. License Grant

3.1 Limited License

We grant you a limited, non-exclusive, non-transferable, revocable license to:

• Download and install the App on your personal mobile device
• Use the App for your personal, non-commercial entertainment purposes
• Access and use the features and content available in the App

3.2 Restrictions

You agree NOT to:

• Modify, reverse engineer, decompile, or disassemble the App
• Remove, alter, or obscure any copyright, trademark, or proprietary notices
• Use the App for any commercial purpose or for any public display
• Attempt to gain unauthorized access to any part of the App or its servers
• Distribute, sublicense, rent, lease, or lend the App to any third party
• Use any automated system (bots, scripts) to interact with the App
• Interfere with or disrupt the App's operation or servers

4. Advertising

4.1 Ad-Supported Model

The App is provided to you free of charge, supported by advertising revenue. You acknowledge and agree that:

• Advertisements are an integral part of the App experience
• We may display banner and interstitial ads during your use of the App
• Ad frequency and placement may change without notice
• Continued use of the App constitutes acceptance of advertising

4.2 Ad Types and Frequency

The App displays the following types of advertisements:

• Banner Ads: Small advertisements displayed on the main menu screen
• Interstitial Ads: Full-screen advertisements shown every 3 completed games
• Ad frequency is subject to change to optimize user experience and revenue

4.3 Third-Party Advertising

Advertisements are provided by Google AdMob, a third-party advertising service:

• We do not control the content of third-party advertisements
• Ads may be personalized based on your advertising ID and usage patterns
• Google AdMob collects data as described in our Privacy Policy
• You can opt-out of personalized ads via your device settings
• We are not responsible for any products or services advertised

4.4 User Obligations Regarding Ads

You agree to:

• View ads in good faith without attempting to manipulate impressions
• Not use ad-blocking software or techniques to circumvent advertisements
• Not click on ads fraudulently or excessively
• Not interfere with ad loading or display mechanisms
• Report any inappropriate ad content to us promptly

4.5 Internet Connection

An active internet connection is required for advertisements to load. You are responsible for:

• Your own data charges when using cellular data
• Ensuring adequate connectivity for ad display
• Understanding that ads may not display without internet access

5. Intellectual Property Rights

5.1 Our Rights

All intellectual property rights in the App, including but not limited to:

• Source code, object code, and software architecture
• Graphics, animations, sound effects, and music
• Game mechanics, rules, and design elements
• The "Lumi Blocks" name, logo, and branding
• Documentation and instructional materials

are owned by Atech Engineering Solutions SRL or our licensors and are protected by international copyright, trademark, and other intellectual property laws.

5.2 Game Inspiration

Lumi Blocks is an original block-stacking puzzle game inspired by classic falling-block games. We do not claim any association with or endorsement by The Tetris Company. Our game features unique mechanics, board dimensions, and gameplay elements that distinguish it as an independent creation.

5.3 User-Generated Content

The App does not currently support user-generated content. High scores and settings are stored locally on your device and are not shared with us or other users.

6. Privacy and Data

Your privacy is important to us. Our collection and use of your information is governed by our Privacy Policy, which is incorporated into these Terms by reference.

7. User Conduct

You agree to use the App responsibly and not to:

• Use the App in any way that violates applicable laws or regulations
• Attempt to cheat, hack, or exploit game mechanics
• Use third-party tools to modify game behavior or scores
• Impersonate others or provide false information
• Harass, abuse, or harm others (if future social features are added)
• Use the App in a manner that could damage our reputation

8. Disclaimers and Limitations

8.1 "As Is" Provision

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

• Warranties of merchantability or fitness for a particular purpose
• Warranties that the App will be uninterrupted or error-free
• Warranties regarding accuracy, reliability, or availability
• Warranties that defects will be corrected

8.2 No Warranty on Advertisements

We make no warranties regarding third-party advertisements, including:

• Accuracy of advertising content or claims
• Safety or legality of advertised products or services
• Availability of advertised offers

Any transactions you make with advertisers are solely between you and the advertiser.

8.3 Use at Your Own Risk

You acknowledge that:

• Your use of the App is at your sole risk
• We are not responsible for any device damage or data loss
• You should maintain backups of important device data
• Some users may experience motion sickness or eye strain

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

• WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES
• WE SHALL NOT BE LIABLE FOR ANY LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES
• OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE APP (WHICH IS ZERO)
• THESE LIMITATIONS APPLY EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES

Some jurisdictions do not allow the limitation of liability for incidental or consequential damages, so these limitations may not apply to you.

10. Indemnification

You agree to indemnify, defend, and hold harmless Atech Engineering Solutions SRL, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

• Your use or misuse of the App
• Your violation of these Terms
• Your violation of any rights of another party
• Your violation of applicable laws or regulations

11. Termination

11.1 Termination by You

You may terminate this agreement at any time by:

• Uninstalling the App from your device
• Ceasing all use of the App
• Deleting all copies of the App in your possession

11.2 Termination by Us

We reserve the right to terminate or suspend your access to the App at any time, without notice, for:

• Violation of these Terms
• Fraudulent, abusive, or illegal activity
• Extended periods of inactivity
• Technical or security reasons
• Any other reason at our sole discretion

11.3 Effect of Termination

Upon termination:

• Your license to use the App immediately ends
• You must uninstall the App and delete all copies
• Locally stored data may be deleted
• Provisions regarding intellectual property, liability, and indemnification survive termination

12. Updates and Modifications

We may release updates to the App from time to time:

• Updates may add, modify, or remove features
• Updates may be automatic or require manual download
• Updates may change how advertisements are displayed
• Continued use after an update constitutes acceptance of changes
• We are not obligated to provide updates or maintain the App indefinitely

13. Third-Party Services

13.1 Google AdMob

The App integrates with Google AdMob for advertising:

• AdMob is subject to Google's Terms of Service and Privacy Policy
• We are not responsible for Google's data practices

13.2 App Store Terms

Your use of the App is also subject to:

• Google Play Store Terms of Service (Android)
• Apple App Store Terms of Service (iOS)
• Any other applicable platform terms

14. Geographic Restrictions

The App is available worldwide through major app stores. However:

• We make no representation that the App is appropriate or available in all locations
• Access from territories where the content is illegal is prohibited
• You are responsible for compliance with local laws
• Advertisements may be targeted based on your location

15. Children

The App is suitable for users of all ages, including children:

• We comply with COPPA (Children's Online Privacy Protection Act)
• We do not knowingly collect personal information from children under 13
• Ads shown to children are non-personalized and age-appropriate
• Parents should supervise children's use of the App
• Contact us if you believe a child has provided personal information

16. Dispute Resolution

16.1 Governing Law

These Terms are governed by and construed in accordance with the laws of Romania, without regard to conflict of law principles.

16.2 Jurisdiction

Any disputes arising from these Terms or your use of the App shall be subject to the exclusive jurisdiction of the courts of Iasi, Romania.

16.3 Informal Resolution

Before filing a legal claim, you agree to contact us at sales@atech-tools.com to attempt to resolve the dispute informally.

17. Severability

If any provision of these Terms is found to be invalid or unenforceable:

• That provision shall be limited or eliminated to the minimum extent necessary
• The remaining provisions shall remain in full force and effect
• We may replace the invalid provision with a valid one that achieves the same objective

18. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Atech Engineering Solutions SRL regarding the App and supersede all prior agreements and understandings.

19. No Waiver

Our failure to enforce any right or provision of these Terms will not constitute a waiver of such right or provision. Any waiver must be in writing and signed by us.

20. Assignment

You may not assign or transfer these Terms or your rights under them without our prior written consent. We may assign these Terms without restriction.
