4. Use of the App

We grant you a limited, non-exclusive, non-transferable, revocable license to:

• Access and use the App for personal or business purposes
• View and download product information for your own use

This license does not include the right to:

• Modify, copy, distribute, or create derivative works
• Use content for commercial purposes without permission

8. Disclaimers and Limitations of Liability

• The App will be uninterrupted, secure, or error-free

• Any errors or defects will be corrected
• The App will meet your specific requirements
• The App will be compatible with all devices or operating systems

8.3 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ATECH ENGINEERING SOLUTIONS SRL SHALL NOT BE LIABLE FOR:

• Any indirect, incidental, special, consequential, or punitive damages
• Loss of profits, revenue, data, or business opportunities
• Service interruptions or data loss
• Errors or omissions in product information
• Unauthorized access to your account or data
• Any damages arising from use or inability to use the App

Our total liability shall not exceed the amount paid by you (if any) for using the App in the 12 months preceding the claim.

• Any damages resulting from third-party service failures

9. Indemnification

You agree to indemnify, defend, and hold harmless Atech Engineering Solutions SRL, its officers, directors, employees, and agents from any claims, damages, liabilities, costs, or expenses (including reasonable attorneys' fees) arising from:

• Your use or misuse of the App
• Your violation of these Terms and Conditions
• Your violation of any rights of another party
• Your violation of any applicable laws or regulations
• Any content you submit or transmit through the App

10. Modifications to Terms

We reserve the right to modify these Terms and Conditions at any time. Changes will be effective immediately upon posting in the App or on our website. We will notify you of significant changes by:

• Prominent notice on the legal pages

Your continued use of the App after changes constitutes acceptance of the modified terms. If you do not agree to the changes, you must stop using the App and delete your account.

The App is controlled and operated from Romania. We make no representation that the App is appropriate or available for use in other locations. If you access the App from outside Romania, you do so at your own risk and are responsible for compliance with local laws.

13. Governing Law and Jurisdiction

These Terms and Conditions shall be governed by and construed in accordance with the laws of Romania, without regard to its conflict of law provisions.

Any disputes arising out of or relating to these Terms or the App shall be resolved exclusively in the courts of Romania. You consent to the personal jurisdiction of such courts.

14. Dispute Resolution

14.1 Informal Resolution

Before filing any formal claim, you agree to contact us to attempt to resolve the dispute informally by sending a written notice to sales@atech-tools.com.

14.2 Arbitration

If informal resolution fails, disputes may be resolved through binding arbitration in accordance with Romanian arbitration laws, unless prohibited by applicable law.

14.3 Class Action Waiver

You agree to bring claims only in your individual capacity and not as part of any class or representative action.

15. Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it valid and enforceable.

16. Entire Agreement

These Terms and Conditions, together with our Privacy Policy, constitute the entire agreement between you and Atech Engineering Solutions SRL regarding the use of the App and supersede all prior agreements and understandings.

17. Waiver

Our failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision. Any waiver must be in writing and signed by an authorized representative.

18. Assignment

You may not assign or transfer these Terms or your account to any third party without our prior written consent. We may assign or transfer these Terms at any time without restriction.

19. Force Majeure

We shall not be liable for any failure or delay in performance due to circumstances beyond our reasonable control, including but not limited to:

• Natural disasters, acts of God
• War, terrorism, civil unrest
• Government actions or regulations
• Internet or telecommunications failures
• Power outages or equipment failures
• Pandemics or public health emergencies

20. Survival

The following sections shall survive termination of these Terms: Intellectual Property Rights, Disclaimers and Limitations of Liability, Indemnification, Governing Law, and any other provisions that by their nature should survive.

21. App Store Terms

21.1 Apple App Store

If you download the App from the Apple App Store, you acknowledge and agree that:

• These Terms are between you and Atech Engineering Solutions SRL, not Apple
• Apple has no obligation to provide maintenance or support
• Apple is not responsible for product liability claims
• Apple is a third-party beneficiary of these Terms
• You will comply with Apple's App Store Terms of Service

21.2 Google Play Store

If you download the App from Google Play Store, you acknowledge and agree that:

• These Terms are between you and Atech Engineering Solutions SRL, not Google
• Google has no obligation or liability regarding the App
• You will comply with Google Play Store Terms of Service
