By downloading, accessing, or using the SwiftMap mobile application ("App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the App.
These Terms constitute a legally binding agreement between you and Atech Engineering Solutions SRL ("Company", "we", "us", or "our").
SwiftMap is a gig-economy platform that connects Requesters (users who need assistance with short-duration tasks) with Helpers (users who fulfil those tasks in exchange for a monetary bounty). The App facilitates the discovery, acceptance, and completion of these tasks.
You are responsible for maintaining the confidentiality of your account credentials. You agree to notify us immediately at sales@atech-tools.com if you suspect any unauthorised use of your account.
You may operate in two modes within the App: Requester and Helper. You may switch between modes at any time.
Before accepting tasks as a Helper, you must complete identity verification. By submitting your identification documents, you consent to our verification process. We reserve the right to refuse or revoke verification at our sole discretion.
Payment processing is handled by Stripe, Inc. By using payment features, you agree to Stripe's Terms of Service.
Escrow: When a Requester posts a task, the full bounty amount is immediately reserved (held in escrow) from their wallet balance. The Requester's wallet is debited at posting time, not at completion. If the task expires or is cancelled before a Helper verifies completion, the reserved amount is refunded to the Requester subject to the cancellation policy below.
The following fees apply:
Example: a $20 bounty task completed by a first-time Helper yields $20 − $2.00 (platform) − $0.50 (safety) − $2.00 (KYC) = $15.50 net to the Helper.
The Safety Shake feature requires a 4-digit PIN exchange between the Requester and Helper to confirm in-person arrival and initiate task completion. Both parties must be physically co-located to use this feature.
You agree not to:
Free cancellation: Requesters may cancel a task at no charge while it is in live status and no Helper has accepted it. The full bounty is returned to the Requester's wallet.
Late-cancellation fee: If a Requester cancels after a Helper has accepted or arrived, a 10% cancellation fee is withheld from the refund to compensate the Helper for their time and travel. The remaining bounty (90%) is returned to the Requester's wallet.
Excessive cancellations: Requesters who accumulate more than 3 late-cancellations within any rolling 30-day period may have their account suspended pending review.
Helper back-out: If a Helper backs out of an accepted task, the full bounty remains in escrow and the task returns to live status for another Helper to accept. Repeated back-outs may result in account restrictions.
Disputes: To raise a payment dispute or report a problem with a completed task, contact sales@atech-tools.com within 7 days of the task completion date.
SwiftMap operates exclusively as a technology marketplace and payment intermediary. We connect independent Requesters and Helpers; we do not employ, direct, or supervise Helpers, and we are not a party to any task agreement formed through the App.
Helpers are independent individuals acting on their own account. Nothing in these Terms or in the use of the App creates an employment relationship, agency, partnership, or joint venture between the Company and any Helper or Requester.
Each user is solely responsible for determining and fulfilling their own tax obligations arising from income earned or payments made through the App. In Romania this includes, without limitation, obligations under the Fiscal Code (Legea nr. 227/2015) and any applicable local or EU tax regulations.
The Company does not provide tax advice. We recommend consulting a qualified tax professional regarding your individual circumstances. We may be required by applicable law to report certain payment information to tax authorities.
To the maximum extent permitted by law, the Company shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or relating to your use of the App, including damages for personal injury, property damage, lost profits, or data loss.
The Company is a marketplace platform and is not responsible for the actions, omissions, or conduct of any Requester or Helper.
The App is provided "as is" without warranties of any kind, either express or implied. We do not warrant that the App will be uninterrupted, error-free, or free of viruses.
These Terms shall be governed by and construed in accordance with the laws of Romania, without regard to its conflict of law provisions. Any disputes shall be subject to the exclusive jurisdiction of the courts of Iași, Romania.
We reserve the right to modify these Terms at any time. We will notify you of material changes via the App or by email. Continued use of the App after such notification constitutes acceptance of the updated Terms.
